PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE CRADLEIQ APPLICATION.
By downloading, installing, or using the CradleIQ mobile application or website (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service. CradleIQ is operated by CradleIQ, Inc. ("CradleIQ," "we," "us," or "our").
Service means the CradleIQ mobile application (iOS and Android), the CradleIQ website at cradleiq.com, and any related features, tools, or APIs. Vehicle Data means all data collected from your connected electric vehicle, including battery state of health, state of charge, cell voltage readings, pack temperature, degradation rate, charging session data, driving behavior signals (acceleration, braking, cornering, speed), odometer readings, and derived metrics. CradleScore™ means the proprietary composite scoring system from 0 to 100 measuring battery health, driver behavior, and charging habits. Verified Report means a CradleIQ-generated summary of Vehicle Data, CradleScore, and battery health metrics. OEM API means the official manufacturer API (including Tesla Fleet Telemetry and Smartcar-supported OEM APIs) through which CradleIQ accesses Vehicle Data. Partner means any third-party insurance company, financial institution, dealership, fleet operator, or other entity to whom CradleIQ may, with your consent, provide data.
To use the Service you must be at least 18 years of age or the age of majority in your jurisdiction, be a legal resident of a jurisdiction where the Service is available, have legal authority to authorize data access to the vehicle(s) you connect (registered owner or explicit permission), agree to these Terms and our Privacy Policy, and have a valid email address. You agree to provide accurate information and maintain the confidentiality of your credentials. One account per user.
CradleIQ provides connection to your electric vehicle via official OEM APIs, collection and processing of Vehicle Data to compute your CradleScore and pillar sub-scores (Battery Health, Driver Behavior, Charging Behavior), display of real-time and historical Vehicle Data, insights and alerts, generation of Verified Reports, and optional matching against Partner programs with your explicit consent.
CradleIQ's access to your vehicle is data-only. We do not and will never attempt to lock or unlock your vehicle, start/stop or remotely operate it, modify any vehicle settings, software, or firmware, or otherwise command your vehicle. To read the latest data, we may briefly wake the vehicle from sleep (a benign readiness signal). We request the minimum permissions necessary from each OEM API.
The CradleScore is an estimate based on available telemetry data and is not a definitive technical assessment. A high score does not guarantee absence of defects or future failures. CradleIQ may update the scoring algorithm, which can change your score. The CradleScore and associated insights are informational only and do not constitute professional automotive diagnosis, warranty assessment, or legal, financial, or engineering advice. Verified Reports are informational and not equivalent to a certified third-party inspection; CradleIQ is not liable for reliance on them.
CradleIQ offers a free tier and a paid Pro subscription (monthly or annual). Verified Reports are available as a one-time purchase. All payments are processed through Apple App Store or Google Play Store; CradleIQ does not directly store or process payment card information. You may cancel your Pro subscription at any time; cancellation takes effect at the end of the current billing period. Price changes will be communicated at least 30 days in advance.
CradleIQ collects Vehicle Data (battery, cell, thermal, charging, driving behavior, odometer, location for data context, vehicle metadata) and Account Data (name, email, device identifiers, usage data). Data is used to compute your score, generate insights, create Verified Reports, improve the Service, and communicate with you. Any sharing with Partners is strictly opt-in, purpose-specific, and revocable. CradleIQ does not sell your personal Vehicle Data for advertising. You have rights to access, correction, deletion, portability, and withdrawal of consent. Data is retained while your account is active plus 90 days after deletion, then deleted or anonymized. Security: TLS 1.3 in transit, AES-256 at rest, restricted access with MFA. California residents have additional CCPA rights. The Service is not directed to individuals under 18.
CradleIQ owns all rights to the Service, the CradleScore™ algorithm, Verified Report format, and associated technology. You retain ownership of your Vehicle Data and grant CradleIQ a non-exclusive license to use it for the purposes described. You may not copy, modify, distribute, sell, reverse engineer, or commercially use the Service without prior written consent. "CradleIQ," "CradleScore," and the CradleIQ logo are trademarks of CradleIQ, Inc.
You may not access data from vehicles you do not own or have permission to access, misrepresent Vehicle Data or CradleScore, circumvent security features, use bots or scrapers, reverse engineer the CradleScore algorithm, interfere with the Service, or use it in violation of law, including data protection and consumer protection laws.
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. CradleIQ disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will identify all vehicle defects. Data accuracy from third-party OEM APIs is not warranted.
To the maximum extent permitted by law, CradleIQ is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, or goodwill, vehicle damage or battery failure, or financial loss from reliance on CradleScore or Verified Reports. CradleIQ's total cumulative liability is limited to the greater of amounts paid in the 12 months preceding the claim or $100.
You agree to indemnify and hold harmless CradleIQ against claims arising from your use of the Service in violation of these Terms, violation of law, unauthorized vehicle connections, misrepresentation of data or scores, or infringement of third-party rights.
The Service may integrate with or link to third-party services, including vehicle manufacturers (Tesla, Ford, GM, etc.), Smartcar, and insurance partners. CradleIQ is not responsible for their privacy practices, terms, or content. Integration does not constitute endorsement.
CradleIQ may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms; material changes will be notified at least 14 days in advance. Your continued use after the effective date constitutes acceptance.
You may terminate at any time by deleting your account. CradleIQ may suspend or terminate accounts for breach, illegal activity, suspected fraud, non-payment, or discontinuation of the Service.
These Terms are governed by the laws of the State of Texas. Disputes will first be resolved informally (30 days), then through binding arbitration under AAA Commercial Arbitration Rules in Austin, Texas. You agree to a class action waiver. Either party may seek injunctive or equitable relief for IP infringement.
Apple App Store and Google Play Store specific terms apply. Apple is not a party to these Terms and has no obligation to provide maintenance or support; Apple has no responsibility for warranty, product liability, or IP claims relating to the Application.
These Terms, together with the Privacy Policy, constitute the entire agreement. If any provision is unenforceable, the remainder stays in effect. CradleIQ may assign these Terms in connection with a merger, acquisition, or sale of assets. CradleIQ is not liable for delays caused by force majeure.
